The websites located at https://atxlogic.com and https://smoketest.atxlogic.com, including all subdomains, pages, and content made available through them (collectively, the “Sites”), are owned and operated by ATX Logic, LLC, a Texas limited liability company (“ATX Logic,” “we,” “us,” and “our”). Certain features of the Sites, including The Smoke Test newsletter described in Section 1.7, may be subject to additional guidelines, terms, or rules, which will be posted on the Sites in connection with such features. All such additional terms, guidelines, and rules are incorporated by reference into these Terms.
THESE TERMS OF USE (THESE “TERMS”) SET FORTH THE LEGALLY BINDING TERMS AND CONDITIONS THAT GOVERN YOUR ACCESS TO AND USE OF THE SITES. BY ACCESSING OR USING THE SITES, YOU ARE ACCEPTING THESE TERMS (ON BEHALF OF YOURSELF OR THE ENTITY THAT YOU REPRESENT), AND YOU REPRESENT AND WARRANT THAT YOU HAVE THE RIGHT, AUTHORITY, AND CAPACITY TO ENTER INTO THESE TERMS (ON BEHALF OF YOURSELF OR THE ENTITY THAT YOU REPRESENT). YOU MAY NOT ACCESS OR USE THE SITES OR ACCEPT THESE TERMS IF YOU ARE NOT AT LEAST 18 YEARS OLD. IF YOU DO NOT AGREE WITH ALL OF THE PROVISIONS OF THESE TERMS, DO NOT ACCESS OR USE THE SITES.
THESE TERMS ARE GOVERNED BY TEXAS LAW, REQUIRE THAT ANY DISPUTE BE BROUGHT EXCLUSIVELY IN THE STATE OR FEDERAL COURTS LOCATED IN TRAVIS COUNTY, TEXAS, INCLUDE A WAIVER OF THE RIGHT TO A JURY TRIAL AND A WAIVER OF CLASS AND REPRESENTATIVE ACTIONS (SECTION 8), AND LIMIT THE REMEDIES AVAILABLE TO YOU IN THE EVENT OF A DISPUTE (SECTIONS 4 AND 5).
Our Privacy Notice, which follows these Terms and is incorporated into them by reference, describes how we collect, use, and share personal data submitted through the Sites.
1.1 License. Subject to these Terms, ATX Logic grants you a non-transferable, non-exclusive, revocable, limited license to access and use the Sites solely for your own informational purposes, including evaluating whether to engage ATX Logic for services, and for your internal business purposes to the extent consistent with these Terms.
1.2 Certain Restrictions. The rights granted to you in these Terms are subject to the following restrictions: (a) you shall not license, sell, rent, lease, transfer, assign, distribute, host, or otherwise commercially exploit the Sites, whether in whole or in part, or any content displayed on the Sites; (b) you shall not modify, make derivative works of, disassemble, reverse compile, or reverse engineer any part of the Sites; (c) you shall not access the Sites in order to build a similar or competitive website, product, or service; (d) you shall not use any robot, spider, scraper, crawler, or other automated means to access the Sites or to collect, extract, or index content from the Sites, except that publicly available search engines may index the Sites for the purpose of creating publicly available searchable indices; (e) you shall not use any content from the Sites to train, fine-tune, evaluate, or otherwise develop any machine learning or artificial intelligence model or system; (f) you shall not use the Sites to send unsolicited communications, to submit false or misleading information through any form on the Sites, or to interfere with the operation or security of the Sites; and (g) except as expressly stated herein, no part of the Sites may be copied, reproduced, distributed, republished, downloaded, displayed, posted, or transmitted in any form or by any means. Unless otherwise indicated, any future release, update, or other addition to the functionality of the Sites shall be subject to these Terms. All copyright and other proprietary notices on the Sites (or on any content displayed on the Sites) must be retained on all copies thereof.
1.3 Information Submitted Through the Sites. The Sites allow you to submit information to us, including through the contact form and the newsletter sign-up form. Any information or materials you submit through the Sites, including descriptions of your business, operations, systems, or objectives, will not be treated as confidential or proprietary unless and until you and ATX Logic have entered into a signed written agreement that expressly provides otherwise. By submitting information or materials through the Sites, you or anyone acting on your behalf acknowledge and agree that ATX Logic may use such information or materials for the purpose of responding to your inquiry, evaluating a potential engagement, and as otherwise described in our Privacy Notice, and you represent that you have the right to share such information with us. Do not submit through the Sites any passwords, credentials, customer data, personal data of third parties, or other sensitive information. Information transmitted over the Internet may be intercepted or accessed by others, and ATX Logic is not liable for the protection or privacy of electronic mail or other information transferred through the Internet or any other network that you may use. Please consider this carefully before sending us any information or other materials that you deem confidential or proprietary.
1.4 No Professional Advice; No Guarantee of Results. The content made available on or through the Sites, including articles, tool reviews, case studies, and descriptions of our services, is provided for general informational purposes only. Nothing on the Sites constitutes legal, tax, accounting, financial, investment, engineering, or other professional advice, and nothing on the Sites should be relied upon as a substitute for advice from a qualified professional who is familiar with your specific circumstances. Any results, metrics, timelines, cost savings, or outcomes described on the Sites, including in case studies and client examples, reflect the specific circumstances of particular engagements and are provided for illustrative purposes only. Results depend on factors that vary from organization to organization, including the quality and availability of data, existing systems and processes, and the level of client participation, and ATX Logic makes no representation or warranty that any client or prospective client will achieve similar results. Descriptions of artificial intelligence capabilities, tools, and technologies on the Sites reflect our understanding as of the date indicated and are subject to change as those technologies evolve.
1.5 Client References, Logos, and Testimonials. The Sites may identify companies or individuals with whom ATX Logic has worked and may display their names, logos, or statements about their experience with ATX Logic. Such identification is intended to illustrate ATX Logic’s business relationships and does not constitute an endorsement of ATX Logic by any such company or individual, or an endorsement by ATX Logic of any such company or individual. Testimonials reflect the individual experience and opinion of the person providing them, may have been edited for length or clarity, are not representative of all client experiences, and are not a guarantee of future performance or results. Third-party names, logos, and trademarks displayed on the Sites are the property of their respective owners, and their display does not imply any affiliation with, sponsorship by, or endorsement by such owners.
1.6 Titles, Roles, and References to Agents. Certain individuals may be identified on the Sites by titles such as “Co-Founder,” “Managing Partner,” or “Partner.” Such titles reflect business usage that is customary within the professional services industry and are not intended to indicate that any such individual is a partner of a partnership as that term is used for legal purposes. ATX Logic is a limited liability company organized under the laws of the State of Texas and is not a partnership. References on the Sites to “advisors,” “contractors,” “collaborators,” or similar designations should not be interpreted or construed to mean or imply that such persons are employees of ATX Logic or are under ATX Logic’s supervision or control, or that such persons have authority to bind ATX Logic. References on the Sites to “AI agents,” “agents,” “assistants,” or similar terms describe software systems and do not denote a legal agent of ATX Logic or of any client, and no such software has authority to enter into agreements or make binding commitments on behalf of ATX Logic.
1.7 The Smoke Test Newsletter. ATX Logic publishes an email newsletter, currently titled The Smoke Test, that reviews and grades software tools, including artificial intelligence and software-as-a-service products. The newsletter and its website are hosted and delivered through beehiiv, a third-party newsletter platform. By submitting your email address through the newsletter sign-up form, you consent to receive the newsletter and related communications from ATX Logic at that address and acknowledge that your engagement with the newsletter is measured in the manner described in Section 2 of our Privacy Notice. You may unsubscribe at any time by following the unsubscribe instructions included in each edition or by contacting us as described in Section 9. Reviews, grades, and commentary in the newsletter and on the Sites reflect the opinions and experience of ATX Logic personnel as of the date of publication, are based on our own use of the tools reviewed, and are not endorsements of, or guarantees regarding, any tool. ATX Logic does not receive affiliate commissions, referral fees, free or discounted access, or any other compensation or consideration from vendors whose tools are reviewed. If that changes for any review, ATX Logic will disclose the relationship in the relevant edition. Pricing, features, and availability of reviewed tools are stated as of the date of publication and are subject to change by the applicable vendor without notice. Names, logos, and trademarks of reviewed tools are the property of their respective owners, and no review should be read to imply affiliation with, sponsorship by, or endorsement by any vendor.
1.8 Scheduling Links. The Sites may contain links to a third-party scheduling service (such as Calendly) through which you may book a meeting with ATX Logic. Any such service is operated by a third party and is not part of the Sites. Your use of that service, and any information you provide to it, is governed by that third party’s terms of service and privacy policy, and Section 3 of these Terms applies to your use of it.
1.9 Modification. ATX Logic reserves the right, at any time, to modify, suspend, or discontinue the Sites or any content or feature of the Sites (in whole or in part) with or without notice to you. You agree that ATX Logic will not be liable to you or to any third party for any modification, suspension, or discontinuation of the Sites or any part thereof.
1.10 No Support or Maintenance. You acknowledge and agree that ATX Logic will have no obligation to provide you with any support or maintenance in connection with the Sites.
1.11 Ownership. You acknowledge that all intellectual property rights, including copyrights, trademarks, service marks, trade dress, and trade secrets, in the Sites and their content, including all text, graphics, logos, images, page designs, software, code, and the selection and arrangement thereof, are owned by ATX Logic or ATX Logic’s licensors and are protected by United States and international intellectual property laws, whether or not registered. The ATX Logic name and logo and The Smoke Test name are proprietary marks of ATX Logic. Neither these Terms nor your access to the Sites transfers to you or any third party any rights, title, or interest in or to such intellectual property rights, except for the limited access rights expressly set forth in Section 1.1. ATX Logic and its licensors reserve all rights not granted in these Terms. There are no implied licenses granted under these Terms.
1.12 Relationship to Client Agreements. These Terms govern your access to and use of the Sites only. The services ATX Logic provides to its clients are governed exclusively by the proposal, statement of work, master services agreement, or other written agreement executed between ATX Logic and the applicable client (each, a “Client Agreement”). Nothing in these Terms is intended to modify, amend, or supersede any Client Agreement, and in the event of any conflict between these Terms and a Client Agreement with respect to the services, the Client Agreement will govern.
You agree to indemnify and hold ATX Logic (and its members, managers, officers, employees, contractors, and agents) harmless, including from costs and attorneys’ fees, from any claim or demand made by any third party due to or arising out of (a) your use of the Sites, (b) any information or materials you submit through the Sites, (c) your violation of these Terms, or (d) your violation of applicable laws or regulations. ATX Logic reserves the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of such claims. You agree not to settle any matter without the prior written consent of ATX Logic. ATX Logic will use reasonable efforts to notify you of any such claim, action, or proceeding upon becoming aware of it.
3.1 Third-Party Links and Content. The Sites may contain links to third-party websites, services, and content, including scheduling services, the websites of tools reviewed in The Smoke Test, and other resources (collectively, “Third-Party Links”). Such Third-Party Links are not under the control of ATX Logic, and ATX Logic is not responsible for any Third-Party Links or for the content, products, services, or practices of any third party. ATX Logic provides access to these Third-Party Links only as a convenience to you, and does not review, approve, monitor, endorse, warrant, or make any representations with respect to Third-Party Links. You use all Third-Party Links at your own risk and should apply a suitable level of caution and discretion in doing so. When you click on any Third-Party Link, the applicable third party’s terms and policies apply, including the third party’s privacy and data gathering practices. You should make whatever investigation you feel necessary or appropriate before proceeding with any transaction in connection with any Third-Party Link.
3.2 Release. You hereby release and forever discharge ATX Logic (and its members, managers, officers, employees, contractors, agents, successors, and assigns) from, and hereby waive and relinquish, each and every past, present, and future dispute, claim, controversy, demand, right, obligation, liability, action, and cause of action of every kind and nature (including personal injuries, death, and property damage) that has arisen or arises directly or indirectly out of, or that relates directly or indirectly to, the Sites, including any Third-Party Links. To the extent any applicable law limits the effectiveness of a general release with respect to claims that are not known or suspected at the time the release is given, you knowingly waive the benefit of such law to the maximum extent permitted.
THE SITES AND ALL CONTENT MADE AVAILABLE THROUGH THEM ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, AND ATX LOGIC (AND OUR LICENSORS AND SERVICE PROVIDERS) EXPRESSLY DISCLAIM ANY AND ALL WARRANTIES AND CONDITIONS OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ALL WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, ACCURACY, OR NON-INFRINGEMENT. WE (AND OUR LICENSORS AND SERVICE PROVIDERS) MAKE NO WARRANTY THAT THE SITES WILL MEET YOUR REQUIREMENTS, WILL BE AVAILABLE ON AN UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE BASIS, OR WILL BE ACCURATE, RELIABLE, FREE OF VIRUSES OR OTHER HARMFUL CODE, COMPLETE, LEGAL, OR SAFE. WITHOUT LIMITING THE FOREGOING, ATX LOGIC MAKES NO WARRANTY REGARDING THE ACCURACY, COMPLETENESS, OR CURRENCY OF ANY TOOL REVIEW, GRADE, PRICING INFORMATION, CASE STUDY, OR OTHER CONTENT ON THE SITES. IF APPLICABLE LAW REQUIRES ANY WARRANTIES WITH RESPECT TO THE SITES, ALL SUCH WARRANTIES ARE LIMITED IN DURATION TO NINETY (90) DAYS FROM THE DATE OF FIRST USE.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU. SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ATX LOGIC (OR ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS, OR SERVICE PROVIDERS) BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY LOST PROFITS, LOST REVENUE, LOST DATA, LOSS OF BUSINESS OPPORTUNITY, COSTS OF PROCUREMENT OF SUBSTITUTE PRODUCTS OR SERVICES, OR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO THESE TERMS OR YOUR USE OF, OR INABILITY TO USE, THE SITES, EVEN IF ATX LOGIC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. ACCESS TO, AND USE OF, THE SITES IS AT YOUR OWN DISCRETION AND RISK, AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR DEVICE OR COMPUTER SYSTEM, OR LOSS OF DATA, RESULTING THEREFROM.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, OUR AGGREGATE LIABILITY TO YOU FOR ANY DAMAGES ARISING FROM OR RELATED TO THESE TERMS OR THE SITES (FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION) WILL AT ALL TIMES BE LIMITED TO A MAXIMUM OF FIFTY US DOLLARS (U.S. $50). THE EXISTENCE OF MORE THAN ONE CLAIM WILL NOT ENLARGE THIS LIMIT. YOU AGREE THAT OUR LICENSORS AND SERVICE PROVIDERS WILL HAVE NO LIABILITY OF ANY KIND ARISING FROM OR RELATING TO THESE TERMS. THE LIMITATIONS IN THIS SECTION 5 APPLY TO THE SITES ONLY AND DO NOT LIMIT OR MODIFY ANY PROVISION OF ANY CLIENT AGREEMENT.
SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.
Subject to this Section, these Terms will remain in full force and effect while you use the Sites. We may suspend or terminate your rights to use the Sites at any time for any reason at our sole discretion, including for any use of the Sites in violation of these Terms. Upon termination of your rights under these Terms, your right to access and use the Sites will terminate immediately. ATX Logic will not have any liability whatsoever to you for any termination of your rights under these Terms. Even after your rights under these Terms are terminated, the following provisions of these Terms will remain in effect: Sections 1.2 through 1.12 and Sections 2 through 9.
7.1 Changes. These Terms are subject to occasional revision. If we make any substantial changes, we may notify you by prominently posting notice of the changes on the Sites and, if you subscribe to The Smoke Test, by sending you an email at the address you provided. Any changes to these Terms will be effective upon the earlier of thirty (30) calendar days following our posting of notice of the changes on the Sites or thirty (30) calendar days following our dispatch of an email notice to you (if applicable). These changes will be effective immediately for new users of the Sites. Continued use of the Sites following notice of such changes shall indicate your acknowledgement of such changes and agreement to be bound by the terms and conditions of such changes. The “Last Updated” date at the top of these Terms indicates when they were most recently revised.
7.2 Export. The Sites may be subject to U.S. export control laws and may be subject to export or import regulations in other countries. You agree not to export, reexport, or transfer, directly or indirectly, any U.S. technical data acquired from ATX Logic, or any products utilizing such data, in violation of United States export laws or regulations.
7.3 Electronic Communications. The communications between you and ATX Logic use electronic means, whether you use the Sites, submit a form, or send us emails, or whether ATX Logic posts notices on the Sites or communicates with you via email. For contractual purposes, you (a) consent to receive communications from ATX Logic in an electronic form; and (b) agree that all terms and conditions, agreements, notices, disclosures, and other communications that ATX Logic provides to you electronically satisfy any legal requirement that such communications would satisfy if they were in a hardcopy writing. The foregoing does not affect your non-waivable rights.
7.4 Entire Terms. These Terms, together with the Privacy Notice, constitute the entire agreement between you and us regarding the use of the Sites. Our failure to exercise or enforce any right or provision of these Terms shall not operate as a waiver of such right or provision. The section titles in these Terms are for convenience only and have no legal or contractual effect. The word “including” means “including without limitation.” If any provision of these Terms is, for any reason, held to be invalid or unenforceable, the other provisions of these Terms will be unimpaired and the invalid or unenforceable provision will be deemed modified so that it is valid and enforceable to the maximum extent permitted by law. Nothing in these Terms creates any agency, partnership, joint venture, employment, or fiduciary relationship between you and ATX Logic. These Terms, and your rights and obligations herein, may not be assigned, subcontracted, delegated, or otherwise transferred by you without ATX Logic’s prior written consent, and any attempted assignment, subcontract, delegation, or transfer in violation of the foregoing will be null and void. ATX Logic may freely assign these Terms. The terms and conditions set forth in these Terms shall be binding upon assignees.
7.5 Copyright and Trademark Information. Copyright © 2026 ATX Logic, LLC. All rights reserved. All trademarks, logos, and service marks (“Marks”) displayed on the Sites are our property or the property of third parties. You are not permitted to use these Marks without our prior written consent or the consent of the third party that may own the Marks.
8.1 Governing Law. These Terms, and any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Sites (each, a “Dispute”), shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of laws principles, and, where applicable, the federal laws of the United States.
8.2 Venue. You and ATX Logic agree that any Dispute shall be brought exclusively in the state or federal courts located in Travis County, Texas, and you and ATX Logic hereby irrevocably consent to the personal jurisdiction of, and venue in, such courts and waive any objection based on inconvenient forum. Notwithstanding the foregoing, ATX Logic may seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property rights or to enforce these Terms.
8.3 Waiver of Jury Trial. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU AND ATX LOGIC EACH KNOWINGLY, VOLUNTARILY, AND INTENTIONALLY WAIVE ANY RIGHT TO A TRIAL BY JURY IN ANY ACTION, PROCEEDING, OR COUNTERCLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SITES, AND AGREE THAT ANY SUCH DISPUTE SHALL BE TRIED BEFORE A JUDGE SITTING WITHOUT A JURY.
8.4 Waiver of Class and Representative Actions. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU AND ATX LOGIC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. THE COURT MAY NOT CONSOLIDATE MORE THAN ONE PERSON’S CLAIMS AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF A REPRESENTATIVE OR CLASS PROCEEDING. IF THIS WAIVER IS FOUND TO BE UNENFORCEABLE AS TO A PARTICULAR CLAIM, THEN THAT CLAIM SHALL BE SEVERED AND PROCEED INDIVIDUALLY, AND THE REMAINDER OF THIS SECTION 8 SHALL CONTINUE TO APPLY.
8.5 Time Limitation on Claims. To the extent permitted by applicable law, any claim or cause of action arising out of or relating to these Terms or the Sites must be filed within two (2) years after such claim or cause of action arose, or be forever barred.

This Privacy Notice (“Notice”) describes how ATX Logic, LLC (“ATX Logic,” “we,” “us,” or “our”) collects, uses, and shares personal data of visitors to and users of https://atxlogic.com and https://smoketest.atxlogic.com (the “Sites”). ATX Logic is the controller of personal data obtained through the Sites, meaning we are the organization responsible for deciding how and for what purposes it is used. This Notice does not apply to information we collect in the course of providing services to our clients, which is governed by the applicable Client Agreement, or to third-party websites or services linked from the Sites. Capitalized terms used but not defined in this Notice have the meanings given in our Terms of Use.
We collect personal data in the following ways:
Information you provide to us. When you submit the contact form on the Sites, we collect the information you enter, which may include your name, email address, company name, job title, phone number, and the contents of your message. When you subscribe to The Smoke Test newsletter, we collect your email address and any other information you choose to provide in the sign-up form. If you correspond with us by email, we collect your name, email address, and the contents of your correspondence, together with any information you include in it.
Information collected automatically. When you visit the Sites, our hosting and infrastructure providers automatically record standard technical information in server logs, which may include your IP address, browser type and version, operating system, referring URL, pages viewed, and the date and time of your visit. We use this information to operate and secure the Sites. If you subscribe to The Smoke Test, the newsletter platform also records information about how you interact with the newsletter and its website, as described in Section 2. We do not use the Sites to serve advertising, and we do not track your activity across other websites.
Information from other sources. If you contact us regarding a potential engagement, we may supplement the information you provide with publicly available professional information, such as information from your company’s website or professional networking profiles, in order to understand your business and respond to your inquiry.
How the newsletter is delivered. The Smoke Test newsletter and its website at https://smoketest.atxlogic.com are hosted and delivered by beehiiv Inc. (“beehiiv”), a third-party newsletter platform that processes subscriber data on our behalf. beehiiv stores subscriber data on servers located in the United States. beehiiv’s own privacy policy, available at https://www.beehiiv.com/privacy, describes its practices in more detail.
Email engagement tracking. Like most email newsletter platforms, beehiiv measures engagement using two standard techniques. First, each edition contains a small, invisible image (often called a tracking pixel) that is loaded from beehiiv’s servers when your email client displays images. When that image loads, beehiiv records that the edition was opened, the date and time, a subscriber identifier associated with your email address, your IP address, an approximate location inferred from your IP address, and information about your email client and device. Second, links in each edition are routed through beehiiv’s servers before redirecting to their destination, which allows beehiiv to record which links you click. If you read an edition in your web browser using the “view in browser” or “read online” link, beehiiv may additionally record standard website analytics for that page, such as time on page and scroll depth. We use this engagement information to understand which reviews and topics are useful to subscribers, to measure the performance of the newsletter, and to maintain a healthy subscriber list. We do not sell this information, and we do not share it with the vendors whose tools we review.
How to limit engagement tracking. You can prevent open tracking by configuring your email client not to load remote images automatically, and you can avoid click tracking by typing a destination address into your browser rather than clicking a link in the newsletter. Unsubscribing stops both the newsletter and any further engagement tracking associated with it.
Cookies on the Sites. The atxlogic.com website does not use cookies or similar technologies for advertising or analytics purposes. The Smoke Test website at smoketest.atxlogic.com is hosted by beehiiv and uses cookies that are strictly necessary for the site to function, such as cookies that remember your subscription status or cookie preferences, and may use analytics cookies to measure how the site is used. Where a cookie banner is displayed on that site, you may use it to decline non-essential cookies. You can also control or delete cookies through your browser settings, although doing so may affect some site functionality. We use personal data for the following purposes:
To respond to your inquiries, questions, and requests, including scheduling and conducting introductory conversations.
To evaluate whether ATX Logic is a fit for your needs and to prepare proposals for services.
To deliver The Smoke Test newsletter and related communications to subscribers.
To operate, maintain, secure, and improve the Sites, including monitoring for and preventing fraudulent, unauthorized, or unlawful activity.
To send you information about ATX Logic’s services, events, or content that we believe may be of interest to you, subject to your right to opt out as described in Section 5.

If we need to use your personal data for an unrelated purpose, we will notify you and, where required by law, obtain your consent. We do not make decisions about you based solely on automated processing that produce legal or similarly significant effects concerning you.
We do not sell personal data, and we do not share personal data with third parties for their own marketing purposes. We share personal data with the following categories of recipients, only as necessary for the purposes described above:
Service providers that perform functions on our behalf, such as website hosting, form processing, email delivery and newsletter distribution, customer relationship management, scheduling, and data storage. These currently include beehiiv Inc., which hosts The Smoke Test website and delivers the newsletter, and the third-party scheduling service through which you may book a meeting with us. These providers are permitted to use personal data only to perform services for us and in accordance with their agreements with us.
Professional advisers, including lawyers, accountants, and insurers, where necessary to obtain their advice or services.
Governmental, regulatory, judicial, or law enforcement authorities where we are required or permitted by law to make a disclosure, or where disclosure is necessary to protect our rights, property, or safety or those of others.
Actual or prospective buyers, investors, or successors in connection with a corporate transaction of the type described in Section 3.
We may also share aggregated or de-identified information that cannot reasonably be used to identify you.
Where permitted by applicable law, we may send you communications about ATX Logic’s services, content, and events. Every marketing email we send includes a working unsubscribe mechanism, and we honor opt-out requests promptly. You may also opt out at any time by contacting us as described in Section 13. If you opt out of marketing communications, we may still send you non-marketing communications, such as responses to your inquiries or communications regarding an existing business relationship.
The Sites contain links to third-party websites and services, including the scheduling service through which you may book a meeting with us and the websites of tools reviewed in The Smoke Test. When you click on a link to any other website, you will leave the Sites, and another entity may collect your personal data. We have no control over, do not review, and are not responsible for these outside websites or their content or privacy practices. This Notice does not apply to those websites or to any collection of your personal data after you leave the Sites. We encourage you to read the privacy policies of every website you visit.
The Sites are intended for business audiences and for use by individuals who are at least 18 years old. We do not knowingly collect personal data from children. If we learn that we have collected personal data from a child, we will delete it as soon as reasonably practicable. If you believe that we might have personal data from a child, please contact us as described in Section 13.
ATX Logic is located in the United States, the Sites are operated from the United States, and our service providers, including beehiiv, store personal data on servers located in the United States. If you access the Sites from outside the United States, you acknowledge that your personal data will be transferred to, stored, and processed in the United States, where data protection laws may differ from those of your country. By using the Sites or providing us with personal data, you consent to such transfer and processing.
Depending on applicable law and your circumstances, you may have rights with respect to your personal data, including the right to request access to the personal data we hold about you, to request that we correct inaccurate personal data, to request that we delete your personal data, to object to or restrict certain processing, and to receive a copy of personal data you provided to us in a portable format. To exercise any of these rights, please contact us as described in Section 13. We may need to verify your identity before responding to a request, and we may decline requests where permitted by applicable law. Where a request relates to subscriber data held by beehiiv on our behalf, we will coordinate with beehiiv to fulfill it. We will not discriminate against you for exercising any right available to you under applicable law.
We retain personal data for as long as necessary to fulfill the purposes for which it was collected, including to satisfy any legal, accounting, or reporting requirements, and to establish, exercise, or defend legal claims. Newsletter subscriber information, including engagement information described in Section 2, is retained until you unsubscribe, after which we retain only the information necessary to honor your opt-out. Contact form submissions and related correspondence are retained for as long as reasonably necessary to evaluate and respond to the inquiry and, where an engagement results, for the duration of the client relationship and any applicable retention period thereafter. Following the end of the applicable retention period, we will delete or anonymize your personal data.
We maintain reasonable administrative, technical, and physical safeguards designed to protect personal data against unauthorized access, use, or disclosure. No method of transmission over the Internet or method of electronic storage is completely secure, however, and we cannot guarantee absolute security.
ATX Logic does not send, and does not permit any employee, contractor, vendor, or third party to send, unsolicited bulk email advertising atxlogic.com, smoketest.atxlogic.com, or any of our services. Commercial email sent by or on behalf of ATX Logic is intended to comply with the CAN-SPAM Act of 2003, including by using accurate header and subject line information, identifying the sender, including a valid physical postal address, and including a working opt-out mechanism. Opt-out requests are honored promptly. To report suspected unsolicited email referencing our domains, contact us as described in Section 13.
